Agreement between Client and Photographer:
Assumption of Risk
The Client understands that participation in a photo session may involve certain risks, including but not limited to uneven terrain, weather conditions, crowds, wildlife, or the use of props. For select sessions, optional creative elements such as controlled fire, smoke, or fog may be used. The Client voluntarily assumes all such risks and agrees to hold the Photographer harmless from any resulting injuries or damages.
Model Release
The Client grants the Photographer and their legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs of the Client and/or the Client's minor children (if applicable), for editorial, trade, advertising, social media, and any other lawful purpose and in any manner, including altering and composite representations, in any media, worldwide. The Client releases all claims to profits, royalties, or other compensation from such use of the images.
Copyright, Ownership, and Print Release
The Photographer retains full copyright ownership of all images captured during the session. The Client will receive access to all edited images via an online gallery, along with a print release that permits printing for personal, non-commercial use. This does not include ownership or unlimited reproduction rights unless otherwise agreed in writing.
Digital Files and Social Media Usage
The Client may use digital files provided by the Photographer for personal, non-commercial purposes, including sharing on personal social media profiles. The Client agrees not to edit, alter, or add filters to the images and to credit Narrative Imagery when sharing.
Cancellation and Rescheduling Policy
The Client understands that a notice of at least 14 days is required to cancel or reschedule the session. In the event of cancellation without the required notice, the session fee may be non-refundable. If the Photographer must cancel or reschedule due to unforeseen circumstances, the session will be rescheduled at no additional charge to the Client.
Liability Release
The Client agrees to hold harmless, release, and forever discharge Narrative Imagery, its employees, agents, representatives, and assigns from all claims, demands, and causes of action that the Client may have by reason of this authorization.
Minor Children
If any individual being photographed is a minor, the undersigned parent or legal guardian warrants that they have the legal authority to consent to the use of photographs as described in this Agreement.
Payment Terms
The Client agrees to pay the session fee of (or as listed in the selected package) before or at the time of the session. Accepted payment methods include Cash, Venmo, Zelle or Check. No images will be delivered until full payment is received.
Session Timing
Sessions begin at the scheduled start time. Clients are expected to arrive at least 10 minutes early and be ready to begin. Late arrival may result in reduced shooting time. Additional time beyond the scheduled session may incur additional fees.
Image Delivery & Edits
Edited images will be delivered via an online gallery within 3-6 weeks of the session. The Photographer retains full creative control over which images are edited and delivered. RAW files or unedited images will not be provided.
Cooperation
The Client agrees to follow Photographer direction during the session and be respectful of locations, time, and session boundaries. The Photographer is not responsible for uncooperative subjects, missed moments due to lateness, or personal dissatisfaction not related to photographic quality.
Damage to Property
The Client is responsible for any and all damages caused by the Client, their guests, pets, or agents to the Photographer's equipment, props, or contracted locations (e.g., rental studios). The Client agrees to pay the cost of repair or replacement for such damaged property within thirty (30) days of receiving an invoice from the Photographer.
Illness and Incapacity
In the event that the Photographer becomes ill, injured, or has a personal emergency that prevents them from performing the session, the Photographer will notify the Client as soon as possible. The Photographer’s liability shall be limited to the following:Rescheduling the session at the earliest mutual convenience; orProviding a full refund of any fees paid by the Client if a reschedule is not possible. Narrative Imagery shall not be held liable for any additional costs incurred by the Client (such as hair/makeup, travel, or venue fees) due to the Photographer’s inability to perform.
