AGREEMENT BETWEEN NARRATIVE IMAGERY AND CLIENT.
AGREEMENT BETWEEN NARRATIVE IMAGERY AND CLIENT
Wedding Photography Agreement & Release
This Wedding Photography Agreement (“Agreement”) is entered into between Narrative Imagery (“Photographer”) and the undersigned client(s) (“Client”). By signing this Agreement, the Client acknowledges that they have read, understood, and agree to the following terms.
1. Scope of Services
The Photographer agrees to provide wedding photography coverage as outlined in the selected wedding package. Coverage begins and ends at the times agreed upon prior to the event.
Any additional coverage requested on the wedding day is subject to the Photographer’s availability and will be billed at the Photographer’s standard hourly rate.
2. Assumption of Risk
The Client understands that participation in wedding photography may involve certain risks, including but not limited to uneven terrain, weather conditions, crowds, low-light environments, lighting equipment, or the use of props.
For select weddings or creative sessions, optional artistic elements such as controlled smoke, fog, or fire effects may be used only when safe, permitted, and agreed upon in advance. The Client voluntarily assumes all such risks and agrees to hold the Photographer harmless from any resulting injury, damage, or loss.
3. Model Release
The Client grants the Photographer and their legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs from the wedding, including images of the Client and guests, for editorial, trade, advertising, social media, website, portfolio, and any other lawful purpose, in any manner and in any media, worldwide. The Client releases all claims to profits, royalties, or other compensation arising from such use.
Requests to restrict use of specific images for privacy reasons must be made in writing prior to the wedding day.
4. Copyright, Ownership, and Print Release
All photographs and digital files remain the sole property and copyright of the Photographer.
The Client is granted a personal print release, which allows printing and sharing of images for personal, non-commercial use only. Images may not be sold, altered, submitted to publications, vendors, or contests, or used for commercial purposes without written permission from the Photographer.
5. Digital Files and Social Media Usage
The Client may share delivered images online for personal use. The Client agrees not to apply filters, crops, or edits that alter the Photographer’s work and agrees to credit Narrative Imagery when sharing on social media.
6. Payment Terms
To secure the wedding date, a non-refundable retainer of 25% of the total package price (or as listed on the invoice) is required at the time of booking. The remaining balance is due no later than two (2) weeks before the wedding date.
No images will be delivered until full payment is received. Accepted payment methods include Cash, Check, Venmo, or Zelle.
7. Cancellation, Rescheduling, and Postponement
The retainer is non-refundable and reserves the Photographer’s services exclusively for the Client’s wedding date.
-
If the wedding is postponed or rescheduled, the Photographer will make reasonable efforts to accommodate the new date. If unavailable, the retainer remains non-refundable.
-
If the wedding is canceled entirely, payments made beyond the retainer will be refunded only if cancellation occurs at least 60 days before the wedding date.
-
If the Photographer must cancel due to serious illness, emergency, or unforeseen circumstances, all payments (including the retainer) will be refunded in full, and reasonable efforts will be made to assist the Client in finding a replacement photographer.
-
8. Venue and Vendor Rules
The Photographer will comply with all venue rules and restrictions. It is the Client’s responsibility to ensure photography is permitted at all locations and that the Photographer is granted sufficient access and time for coverage.
9. Liability and Equipment Failure
While all reasonable care will be taken, the Photographer limits any liability for loss, damage, or failure of images to the return of all payments received.
In the unlikely event of equipment failure, data corruption, or circumstances beyond the Photographer’s control, every reasonable effort will be made to recover or re-shoot portions of the event when possible.
10. Image Delivery & Editing
Edited images will be delivered via an online gallery within 6–8 weeks following the wedding date.
The Photographer retains full creative discretion regarding image selection and editing style. RAW or unedited files will not be provided under any circumstance.
11. Artistic Style and Cooperation
The Client acknowledges that they are familiar with the Photographer’s style and portfolio. The Photographer cannot guarantee specific poses, expressions, or moments that depend on timing, cooperation, lighting, or environmental factors.
The Photographer is not responsible for missed images due to schedule delays, uncooperative subjects, guest interference, or venue restrictions.
12. Damage to Property
The Client is responsible for any damage caused by the Client, guests, pets, or agents to the Photographer’s equipment, props, or contracted locations (including rental studios). Costs for repair or replacement must be paid within thirty (30) days of invoice.
13. Illness and Incapacity
If the Photographer becomes ill, injured, or experiences an emergency preventing performance, liability is limited to either:
-
Rescheduling at the earliest mutual convenience, or
-
A full refund of all fees paid if rescheduling is not possible. Narrative Imagery shall not be held liable for any additional costs incurred by the Client, including hair, makeup, travel, or venue expenses.
-
14. Limitation of Liability
The Client agrees to hold harmless, release, and forever discharge Narrative Imagery, its employees, agents, representatives, and assigns from all claims, demands, or causes of action arising from this Agreement or participation in the event.
15. Entire Agreement
This Agreement constitutes the entire understanding between the parties. Any modifications must be made in writing and signed by both parties.
By signing below, the Client acknowledges that they have read, understood, and agreed to all terms of this Wedding Photography Agreement.
